Terms of purchase

These terms apply when you buy seminars or therapy sessions from Berg Psykologer AS (org. no. 935 632 501).

What you buy

A digital seminar gives your personal account access to the video content, including any live session and its recording. An in-person ticket admits one named participant. Access is personal and may not be shared or resold.

Confidentiality and professional responsibility

Our courses contain clinical demonstrations in which participants talk about their own health problems. That information was given for teaching purposes, with the consent of the people concerned, and it remains confidential health information about identifiable people.

By buying access you undertake to treat everything you learn about identifiable people through a course as confidential, on the same terms as information you receive in your own practice. You may not reproduce, share, show, download or record any content depicting or describing identifiable people, in whole or in part, including in teaching, supervision or on social media.

You also undertake to use what you learn only within your own scope of practice. Courses reserved for healthcare professionals can only be bought once we have approved you as a licensed healthcare professional subject to oversight by a licensing body, or as enrolled in a programme leading to a licensed health profession. You accept the confidentiality undertaking when you create an account, and again at checkout.

A breach may in addition be a breach of your own duty of confidentiality as a healthcare professional. What a breach costs is set out under misuse of content and access below.

Misuse of content and access

This section covers all content on the platform: video, live sessions, recordings, slides, caption files, worksheets and course descriptions.

Identifiable person means anyone who can be recognised by someone, directly or indirectly, from an image, a voice, a name, a case history or any other detail in the content.

Commercial misuse

You may not:

1. sell, rent out, lend or otherwise transfer your access
2. give others access to your account, including by sharing login details
3. reproduce content, in whole or in part, in your own teaching, supervision, courses or other paid offering
4. use content or the structure of a course to develop a competing offering
5. download, copy or store content outside the platform for any of the purposes above

On commercial misuse you pay Berg Psykologer AS compensation equal to the highest of:

• 150 % of your financial gain from the misuse
• the ordinary course price multiplied by three, for each person who obtained access without paying
• NOK 25,000

You are obliged to produce documentation of your own gain within 14 days of a written demand. If the documentation does not arrive within that period, Berg Psykologer AS' calculation applies.

Breach of confidentiality

You may not make content showing or describing identifiable people available to anyone outside your own account. This includes showing, forwarding, uploading, streaming or reproducing it, including in teaching, in supervision, in closed forums and on social media. The prohibition applies regardless of how many people receive the content, and regardless of whether the recipient is themselves bound by a duty of confidentiality.

On a breach of confidentiality you pay Berg Psykologer AS compensation of NOK 150,000 for each identifiable person who was exposed.

How the compensation works

The compensation is a minimum amount. It comes in addition to, and not instead of, damages for documented loss exceeding that amount.

Obligations on a breach. Within seven days of becoming aware of a breach, you must remove all content that has been shared, delete every copy you hold outside the platform, give Berg Psykologer AS a written account of who received what and when, and confirm that this has been done. Failure to comply is a separate breach of contract, and may give rise to further claims for damages.

Notification. Breaches of confidentiality are reported to the Norwegian Board of Health Supervision or the equivalent supervisory authority in the country you practise in, to your educational institution if you are a student, and to your employer where relevant. Notification happens independently of whether a financial claim is made, and independently of whether that claim is settled.

Access. Berg Psykologer AS may permanently close your access to our courses without refund on a breach of this section.

Governing law and venue. The agreement is governed by Norwegian law. Oslo District Court is agreed as the venue. Berg Psykologer AS may seek an interim injunction to stop further distribution, without this limiting any other claim.

Prices and payment

Prices are shown in NOK with any VAT included. Payment is by card (Stripe) or Vipps. Employers can order by invoice. Contact kontakt@bergpsykologer.no.

Certificates

A certificate of completion is issued when you finish a seminar. It documents completion and is not an accredited specialist qualification.

Cancellations and changes

If we have to cancel or move an in-person event, you choose between a seat at the new date or a full refund.

Right of withdrawal

As a consumer you normally have a 14-day right of withdrawal when buying online. Digital seminars open immediately after purchase, and the right of withdrawal lapses once delivery has begun; you consent to this at checkout. In-person seminars held at a specific time are exempt from the right of withdrawal. See the right of withdrawal page for the details.

Buying therapy sessions

Therapy sessions are booked in our booking system and apply to the agreed time. Prices are listed on the pricing page. Cancellations within 48 hours are charged half the session fee, and within 24 hours the full fee; weekends do not count toward the deadline. See the pricing page for details. Psychological work beyond the therapy session, such as certificates, referrals, assessments or interpretation of test results, is charged per commenced hour at the same rate as therapy sessions. Complaints

If you are unhappy with a purchase, contact us at kontakt@bergpsykologer.no and describe the problem, and we will resolve it as quickly as we can. If we cannot reach a solution, you may bring the matter to the Norwegian Consumer Authority (Forbrukertilsynet) or the Consumer Disputes Commission (Forbrukerklageutvalget).
